Terms and conditions
All visitors to our website (Workwearclothingonline.com.au) are entering into a binding legal agreement on the following terms and conditions when using the website. This contract is between the visitor and Workwear Clothing Online® and by using this website you accept these terms and conditions.
Our services are available only to, and may only be used by, individuals who can form legally binding contracts under applicable law.
We reserve the right to amend the terms and conditions from time to time, it is your responsibility to check the terms and conditions before placing your order and/or using our website. Your continued use of the Workwear Clothing Online® website will be taken to be acceptance of the new terms.
Orders
Workwear Clothing Online® only processes orders with immediate payment. Therefore, payment of the order needs to be made at the time the order is processed. No orders will be processed without payment.
If there is a missing item(s) when your order is delivered, we will endeavor to ship the item/s when available. If the item/s is no longer available, Workwear Clothing Online® will refund the unit price for the missing item(s) only. Workwear Clothing Online® has the sole legal right to determine to refund, or supply new or replacement items on any order that is delivered with missing or incorrect items.
If stock is unavailable, we shall hold the entire order until the backorder is complete – unless otherwise requested. We will contact you accordingly.
Although every effort is made to ensure consistency of Fabric Colours, Dye lots can vary slightly from batch to batch.
Workwear Clothing Online® will try to deliver all products on time but are not responsible or legally liable for any delays in delivery to the purchaser including if products are not delivered by a specified due date.
You acknowledge that despite our reasonable precautions, products may be listed at an incorrect price or with incorrect information or may be unavailable. This may be due to an error or similar oversight. We reserve the right to cancel an order in that event.
We may also cancel an order if we believe that it is being made in contravention of this agreement, or in contravention of the rights of any person or any law. We may cancel an order even if it has been confirmed and the customer’s credit card has been charged. We reserve this right up until the time of delivery of the product to that customer. If a cancellation of this nature occurs after the customer has been charged for the product, we will immediately credit the customer’s credit card for the amount in question.
Delivery
Delivery will be made by postal or courier service at Workwear Clothing Online’s ® discretion and will be paid for by the customer. The price indicated at time of purchase is an estimate only, and should the freight cost vary once the order is processed, we will contact the customer to confirm the new cost before the order is dispatched.
Workwear Clothing Online® will not be liable for any loss suffered by you if you provide us with incorrect delivery details. It is your responsibility to ensure Workwear Clothing Online® has current details of your postal/delivery address and all other details.
Embroidery
By deciding to use one of Workwear Clothing Online’s® embroiderers, the customer has indicated that they accept these terms & conditions.
The customer will provide us with a high quality image of their logo or their design file in the correct format.
The customer must supply in writing all details that Workwear Clothing Online® will require for embroidery. This will include the embroidery dimensions, position on the garments, specific PMS colours, and more.
Workwear Clothing Online® will then email a quote/invoice for the embroidery work which the customer will need to accept prior to proceeding. If orders are emailed to us, an updated invoice for the order will be sent, so please check it carefully, as this is what Workwear Clothing Online® will use for order processing. Workwear Clothing Online® does not take any responsibility for incorrect stock etc, ordered once the customer has approved the invoice. Approval of the order/invoice details as well as decoration instructions must be confimred in writing (email confirmation accepted).
Once approved, Workwear Clothing Online® will commence on digitising the logo, if required. Once digitised, a visual of the logo will be emailed for approval. Workwear Clothing Online® requires the customer’s approval in writing (email confirmation accepted). The approval of this is Workwear Clothing Online’s® “okay to proceed” with the embroidery. An embroidered sample can be sent if requested; however, the cost (and freight) will need to be paid for upfront by the customer. (For orders of 500 or more, one free stitch sample is included free of charge to ensure the customer is 100% happy with the embroidery, however, freight is for the customers account).
Workwear Clothing Online® will then ship the garments directly to the embroiderer. Workwear Clothing Online® cannot refund or exchange garments once delivered to the embroiderer.
All embroidery will be completed as soon as possible and shipped to the customer.Workwear Clothing Online’s® minimum shipping fee does not include delivery from the embroiderer to the customer.
The pricing on Workwear Clothing Online’s® website is to be used as a guideline and is in no way a firm quote. All embroidery prices are charged as per each individual quote. Workwear Clothing Online® endeavors to get each order out in the quickest possible timeframe assuring the highest quality. However, Workwear Clothing Online® does not accept any responsibility for delays with the order once it is delivered to the embroiderer.
Embroidered items return policy - At your instruction or order, we will ship your order directly to our embroiderer (or the decorator of your choice), however please note we cannot refund or exchange garments once delivered to the embroiderer and decorated. This includes human error when picking the items at the warehouse (we take every measure to ensure this is done as accurately as possible but human error can still occur). Our decorators do not have time to check each garment. WCO reserves the right to refund any embroidery costs only associated with any garment marking - all stock sent to our embroiders are non refundable once embroidered. All shortages or if any embroidery is not up to quality, are required to be submitted in writing within 24hr of receipt and reserves the right to either replace or refund those items only Garments damaged by embroideries on thin materials in which the client has instructed that these items to be embroidered(as some needle damage can occur on rare occasions - especially large or heavily stitched embroideries, or unsuitable materials), will not be refunded or replaced. All freight costs associated with returns are at the clients expense. If these conditions do not meet with your requirements we suggest you use an embroider in close proximity to your location and ask us to provide the stock only.
Returns
Workwear Clothing Online® will only accept returns subject to the following conditions;
The customer must notify Workwear Clothing Online® in writing of their intention to return goods and the return MUST be accompanied by an authorization number issued by Workwear Clothing Online® in writing before such return will be accepted. All goods must be returned to Workwear Clothing Online® within seven days of the receipt by the customer. Goods returned must be accompanied with a copy of the relevant invoice, as well as Workwear Clothing Online’s® authorisation number. The Customer shall be responsible for all charges and costs incurred in returning of goods. If there are any missing item/s in the order, the customer must notify Workwear Clothing Online® in writing within 48 hours of receipt of the goods. This is not apply in cases where the consumer guarantees are not met.
Workwear Clothing Online® shall not accept or agree to a credit claim once the item has been decorated with the approved artwork or on any products where Workwear Clothing Online® has had the goods delivered to our nominated screen printer or embroider or any third party.
Goods decorated are not eligible for return under any circumstances. Workwear Clothing Online® reserves the right to determine what action if any is required on all decorated orders which may be incorrectly decorated. This is not apply in cases where the consumer gauranteees are not met.
Whilst every effort is made to ship goods as ordered, it is the responsibility of the customer to inspect all goods upon receipt, INCLUDING deliveries to Third Parties to verify Styles, Colours and Sizes are as per ordered.
Goods sent as ordered are not returnable under any circumstances unless incorrect style, incorrectly sized or damaged goods have been received by the customer. We cannot refund your purchase if you change your mind. Credit claims shall not be accepted by Workwear Clothing Online® where the goods are samples or orders under ten units.
Discontinued stock items are not eligible for return under any circumstances. Goods returned must be in the original condition as sent "as new", this includes the garment bag being unmarked or they will not be accepted for credit. A 20% or a minimum of $25.00 handling fee will be charged on any credit for the return of all goods. This is not apply in cases where the consumer gauranteees are not met.
Footwear is not eligible for return under any circumstances. This is not apply in cases where the consumer guarantees are not met.
Stormtech garments are not eligible for return under any circumstances. This is not apply in cases where the consumer guarantees are not met.
When you place an online or off line order with Workwear Clothing Online® you are entering into a contract between you as a single entity, the company or organisation you represent and Workwear Clothing Online®. By placing your order you agree to be bound by our Terms and Conditions.
Pricing
All prices are subject to change periodically. If goods are out of stock, we will quote the price accordingly.
General
The customer assumes all risk in the goods at the time of dispatch and it is the customer’s discretion to insure all goods that are at risk.
If the customer requests an order to be sent to a third party, the risk rests with the customer only. Workwear Clothing Online® accepts no liability on any order sent to a third party.
The parties hereby agree that the proper law of all contracts arising between the customer and the Workwear Clothing Online® is the law of the State of Victoria and the parties hereto agree to submit to the jurisdiction of the Courts of that State.
These terms and conditions are the only contractual terms which are binding upon Workwear Clothing Online® as well as any conditions which are imposed and cannot be excluded by law. All other conditions, warranties, representations, statements and obligations, whether expressed or implied are to the extent permitted by law hereby expressly excluded.
